Terms of Use for Uminate iOS apps

Last updated: 16 September 2026

These Terms are an agreement between you and sole proprietor STSIAPAN MALTSAU, registered in the Republic of Uzbekistan under number 6692118 (“Uminate”, “we”), governing your use of our apps for iPhone and iPad (the “Apps”), including JamPad, Beat Machine, Easy Beat and Beat Loop. How we handle data is described in our Privacy Policy.

1. Acceptance

1.1. By downloading, installing or using any of the Apps you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Apps.

1.2. You must be at least 13 years old, or older if the law of your country requires it.

2. Changes to these Terms

2.1. We may change these Terms by publishing an updated version with a revision date. Material changes take effect 30 days after publication, and we will make reasonable efforts to announce them in the Apps. Continuing to use the Apps after changes take effect means you accept the new version.

3. Licence to use the Apps

3.1. We grant you a personal, limited, non-transferable, non-exclusive and revocable licence to install and use the Apps on devices that you own or control, for personal purposes and in accordance with the App Store Usage Rules.

3.2. You may not transfer the Apps to anyone else, decompile, disassemble or reverse engineer them, circumvent technical restrictions, or access paid features without paying for them.

4. Rights in app content

4.1. The sounds, samples, sound packs, design and software of the Apps belong to Uminate or are used by us under licence from their owners, and are protected by law.

4.2. Tracks you create in the Apps may be used freely for personal, non-commercial purposes, including posting them on social media with a credit to the app. Commercial use of recordings containing our sounds and samples requires our written permission — write to support@uminate.com. This section concerns our sounds; it does not transfer ownership of your own creative contribution to us.

4.3. Material you add yourself — voice you record through the microphone and audio files you import from your device — stays yours, and nothing in these Terms transfers it to us. It is stored on your device: the Apps do not upload it, and publishing a track does not include it. You confirm that you hold the rights to every file you import and are responsible for using someone else’s material.

5. Advertising

5.1. Free versions of the Apps are supported by advertising. We may place ads and sponsored material in the Apps and change their format and volume. Ads can be removed by subscribing where a subscription is offered in the app.

6. Subscriptions and purchases

6.1. All purchases are made through Apple In-App Purchase and charged to your Apple Account. Where an App offers the Premium subscription, it is sold in weekly, monthly and yearly options; sound packs are sold as separate one-time purchases. The price in your currency, the length of the period and the current terms are shown on the purchase screen of that App, and those are what apply.

6.2. Subscriptions renew automatically. Payment for the next period is charged within 24 hours before the current period ends, unless you cancel at least 24 hours before that moment.

6.3. You can manage a subscription and turn off auto-renewal in your Apple Account settings: Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.

6.4. If a trial period is offered, its length and conditions are shown on the purchase screen. Any unused part of a trial is forfeited when you buy a paid subscription.

6.5. Purchases are tied to your Apple Account: on a new device they are restored with the “Restore purchases” button on the Premium screen. Refunds are issued by Apple under its own policies; we cannot refund payments ourselves.

7. Prohibited conduct

7.1. When using the Apps you agree not to:

8. Social features and accounts

8.1. Some of the Apps offer optional social features: signing in, a public profile, publishing tracks, comments, likes and a feed (the “Social Features”). Registration is never required: making music, recording, exporting tracks and keeping projects all work without an account.

8.2. An account is created by signing in with Apple or with Google and choosing a public username. You are responsible for activity under your account, agree to provide accurate information, and agree not to choose a username that impersonates someone, infringes the rights of others or is offensive.

8.3. You can delete your account and its data in the app itself: profile → account menu → “Delete account”. You may also request this by writing to support@uminate.com.

9. User content

9.1. “User Content” means everything you publish through the Social Features: tracks (project files and rendered audio), titles, your username, profile bio, profile photo and comments.

9.2. You keep the rights to your own creative contribution. By publishing User Content you grant Uminate a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to store, reproduce, process for technical purposes (rendering audio and previews, re-encoding images), publish, display, perform and distribute that content in connection with operating and promoting the Apps. The licence lasts until the content and reasonable backups are removed from our systems. The sounds and samples themselves remain our intellectual property under section 4.

9.3. You represent that you hold all rights necessary to publish your content and grant this licence, and that it does not infringe the rights of others. You are solely responsible for your User Content.

Remixes

9.4. A published track is the project file behind it. By turning on “Allow remixes” you additionally grant every other user of the Apps a worldwide, non-exclusive, royalty-free licence to download that file inside the Apps and to create, publish and distribute remixes based on it inside the Apps. The permission is off by default and does not extend beyond the Apps.

9.5. A remix is shown with a credit to its source track. Turning the permission off or deleting the track stops new copies of the project file from being handed out, but does not revoke remixes already made. Publishing a remix that does not differ from its source track is not allowed.

10. Community rules

10.1. We have zero tolerance for objectionable content and abusive behaviour. When posting content, a username, profile photo, bio or comment, you agree not to post material that:

11. Moderation, reports and enforcement

11.1. We use automated tools (including Google’s Perspective API for text) and human review. Automated checks apply to text; profile photos are reviewed by a person, usually after a report.

11.2. The Apps include a mechanism for reporting content and users. We review reports and may, at our discretion and without prior notice, remove or hide content, limit its visibility, and warn, suspend or permanently block accounts. Claims about content that infringes your rights should be sent to support@uminate.com.

12. Availability and termination

12.1. We make reasonable efforts to keep the Apps available, but do not guarantee uninterrupted operation: it depends on networks and services outside our control.

12.2. We may modify, suspend or discontinue the Apps or access to them, and may terminate your access if you breach these Terms. You may end this agreement by deleting the Apps. The sections on limitation of liability, governing law and disputes survive termination.

13. Disclaimer and limitation of liability

13.1. The Apps are provided “as is”. To the fullest extent permitted by law we do not warrant that they will be error-free or uninterrupted or fit for your particular purposes.

13.2. To the fullest extent permitted by law, Uminate is not liable for indirect, incidental, punitive or consequential damages, including lost profits and lost data, nor for User Content published by other users or their conduct. Some jurisdictions do not allow such limitations — there they apply to the fullest extent permitted.

14. Apple-specific terms

14.1. These Terms are concluded between you and Uminate, not with Apple Inc. (“Apple”). We, not Apple, are responsible for the Apps and their content.

14.2. Apple has no obligation to furnish maintenance and support for the Apps. For any support question write to support@uminate.com.

14.3. If an App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation, and any claims, losses and expenses arising from a failure to conform to a warranty are our responsibility.

14.4. We, not Apple, are responsible for addressing your claims relating to an App, including product liability, legal and regulatory compliance, consumer protection claims, and claims that an App infringes a third party’s intellectual property rights.

14.5. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

14.6. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

15. Governing law and disputes

15.1. These Terms are governed by the laws of the Republic of Uzbekistan, without regard to conflict-of-law rules, and disputes are subject to the courts of the Republic of Uzbekistan. This does not deprive you of consumer rights guaranteed by mandatory rules of your country of residence.

15.2. These Terms exist in Russian and English; in case of discrepancy the Russian text prevails. Correspondence is conducted in Russian or English.
